PRIVACY POLICY

Thank you for your interest in Topgolf International, Inc. dba Toptracer's ("TTR" or "we" or "our" or "us") range services and mobile app ("Services"). This Privacy Policy details certain policies implemented throughout TTR, governing our collection and use of personally identifiable information about users ("personal information") of our Services.

Privacy Policy Updates

Due to the rapidly evolving nature of online and mobile services, TTR may need to update this Privacy Policy from time to time. If we make revisions that change the way we collect or use your personal information, those changes will be posted in this Privacy Policy, the effective date will be noted at the beginning of this Privacy Policy, and we will ask for your consent to these changes if required by applicable law. TTR encourages you to review this Privacy Policy regularly for any changes. Your continued use of our Services and/or continued provision of personal information to us will be subject to the terms of the then-current Privacy Policy.

Information Collection and Use

In order to use our Services, we may collect personal information from you when you register for and use the Services, such as your name, email, password, player name, and payment card data, for purposes of creating your user profile and account and to provide you with access to certain Services and features. Through your use of our Services, we may use certain profile information (i.e., player name) and may also collect and use your current location to publically post your activity results and in-game play achievements, such as high scores and rankings, to other users of our Services. We may also use your current location information to help you identify TTR ranges in your area. At range locations, we use the camera on your device to scan a QR code to temporarily link your account with the range. We do not store or communicate any images captured by your device. Upon your request, we may use your contact details to send you information necessary to access your account, such as password reset information.

To enter into certain contests and to use enhanced TTR features, such as the ability to track your game progress over time, you may be required to purchase our premium Services. When purchasing our premium Services, we may collect certain billing account information (such as your credit card information) to complete your purchase, and use personal information collected form you (as detailed above) to create your premium account and to grant you access to premium Services, such as premium games and contests, and the ability to track your play history over time. When purchasing the premium Services, we may use your contact details to send you your payment confirmation.

Through your use of our Services on your mobile device, such as smartphones and tablets, we may also use information we collect automatically, such as device type, IP address, operating system, duration of use, pages visited, and error diagnostic data, in order to improve (e.g., analytics) and customize our Services, provide technical support, detect and prevent fraud and violations of TTR's user policies, and send you TTR Services specific to your location such as local tournament information. If you are a registered user on our Services, we may also send you transactional messages about your use of our Services, and you will not be able to opt-out of receiving these transactional messages. With your consent, we may send push notifications to your mobile device, including game updates and other relevant messages. You can manage push notifications form the "options" or "settings" pages within the Services and/or from your mobile device's "settings" page.

Children's Privacy

TTR recognizes the privacy interests of children and we encourage parents and guardians to take an active role in their children's online activities and interests. TTR's Services are not intended for children under the age of 13. TTR does not target Services to children under 13. Further, TTR does not knowingly collect personal information from children under the age of 13.

Disclosure

If you enter and/or have won a contest offered by us through the premium Services, we may collect and use your personal information to provide you prizes and achievements and to comply with any applicable tax regulations and/or any obligations we have in connection with the contests.

If you are a contest winner, we may share your player name, score and range location with other users of our Services. We may also disclose your personal information to any third party service providers who assist us in providing Services to you (such as a payment processor). These service providers will be obligated to use your personal information only to provide the services to us.

When legally required or at TTR's discretion, TTR will cooperate with law enforcement agencies in any investigation of suspicious or alleged illegal activity on our Services. Additionally, your personal information may be shared: (i) in response to legal process (for example, a court order, search warrant or subpoena); (ii) when we have a good faith belief that we are required or permitted to disclose the personal information in response to legal process; (iii) in other circumstances in which TTR believes the TTR Services are being used in the commission of a crime (including exchanging personal information with other companies and organizations for the purposes of fraud protection and credit risk reduction); (iv) when we have a good faith belief that there is an emergency that poses a threat to the safety of you or another person; and (v) when necessary either to protect the rights or property of TTR, including to enforce our policies, or for us to render the Services you have requested.

We will not sell your personal information to any company or organization except we may transfer your personal information to a successor entity upon a merger, consolidation, or other corporate reorganization in which TTR participates or to a purchaser of all or substantially all of TTR's assets to which the Services relates.

How You Can Access or Change Your Information

As permitted by applicable law, you may have certain rights to access, correct, delete, restrict, or object to processing of your personal information, as well as the right to revoke consent for certain processing. If you wish to exercise the aforementioned rights, please contact us as detailed below. To protect your privacy and security, we will verify your identity before responding to such request, and your request will be answered within a reasonable timeframe. To the extent permitted by applicable law, we reserve the right to charge a reasonable fee for certain requests.

Security

We employ procedural and technological security measures that are reasonably designed to help protect your personal information from loss, unauthorized access, disclosure, alteration, or destruction. TTR may use password protection, encryption, and other security measures to help prevent unauthorized access to your personal information.

International Transfers

Our computer systems are currently based in the United States ("U.S."), so your personal information may be processed by us in the U.S., where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Economic Area ("EEA"). We provide appropriate protections for cross-border transfers as required by law for international data transfers, including personal information transferred to third parties. With respect to such transfers from the EEA to the U.S. and other non-EEA jurisdictions, we may rely on the European Union Model Clauses approved by the European Commission and/or the need to process your personal information in order to provide the requested Services to transfer your personal information.

Retention

We will retain your personal information for the period necessary to fulfil the purposes outlined in this Privacy Policy and internal company policies. When TTR no longer needs to use your personal information, we will - unless we need to keep your personal information to comply with applicable legal or regulatory obligations or the personal information is required to carry out corporate tasks and achieve our business objectives - remove it from our systems and records and/or take steps to properly anonymize it so that you can no longer be identified from it.
